Service Changes and Charges
• Pool Copilot reserves the right to update or modify the App at any time.
• We may charge fees for certain services, but we will provide clear advance notice before doing so.
• Changes may be made at our sole discretion and for any reason.
• Any charges will be communicated transparently.
App Updates and Termination
• We may periodically release updates to improve performance, fix bugs, or introduce new features.
• System requirements can change over time, and you may need to accept updates to continue using the App.
• Pool Copilot may terminate app usage without notice for any reason.
• Upon termination, all rights and licenses granted to you immediately end.
Waiver and Release of Liability to Pool Copilot
In consideration of the risk and potential injury that may arise from handling or administering chemicals in contact with living beings or physical property—and in consideration of your decision to use Pool Copilot for chemical dosage and related activities—you acknowledge that your use of the App is voluntary. Accordingly, you waive any and all rights, claims, or causes of action of any kind arising out of your participation in using Pool Copilot and any resulting activities conducted via the App.
Professional Service Provider Terms
1. Service Description
• Pool Copilot (“the App”) provides a platform for pool service management and payment processing between pool service technicians (“Technicians”) and their customers.
• Pool Copilot is not a pool service provider and does not employ Technicians; it only facilitates transactions and interactions within the platform.
2. Subscription Requirements
• A free tier is available for managing up to two pools.
• Additional pools require a Pro or Plus subscription, with associated fees separate from transaction fees.
• Subscriptions can be canceled at any time, but no refunds will be issued for previous charges.
3. Payment Processing & Fees
• Pool Copilot charges a 7% fee on all transactions processed through the platform.
• This fee is subject to change at Pool Copilot’s discretion, and Technicians will be notified in advance.
• A Stripe account may be created on behalf of each Technician for payment processing.
• Technicians are wholly responsible for their own tax obligations and accurate reporting.
• Any updates to the fee structure will be communicated 30 days before going into effect.
4. Technician Responsibilities
• Managing all customer relationships and delivering any required services.
• Addressing customer complaints, service issues, and disputes.
• Managing refunds and billing issues directly with customers.
• Maintaining accurate service records for billing and legal compliance.
• Ensuring compliance with all local laws and regulations.
• Managing subscription billing relationships with customers.
• Maintaining adequate insurance coverage appropriate to the business.
5. Liability & Disclaimers
• Pool Copilot is not responsible for the quality of services delivered by Technicians.
• Pool Copilot does not guarantee customer satisfaction or payment collection.
• The App provides organizational and financial tools but does not assume liability for business outcomes.
• Technicians must indemnify Pool Copilot against any customer claims arising from services.
• Pool Copilot accepts no responsibility for customer disputes or chargebacks.
6. Customer Data & Privacy
• Technicians must safeguard customer data, using it solely for service delivery or related legitimate business needs.
• Technicians must comply with relevant data protection laws and regulations.
• Pool Copilot may access de-identified, aggregate data for internal or analytical purposes.
7. Account Termination
• Pool Copilot reserves the right to terminate accounts that violate these terms.
• No refunds will be granted upon termination.
• Technicians must complete any outstanding service obligations.
• Customer data must continue to be protected and handled according to privacy regulations.
8. Dispute Resolution
• All disputes arising from these terms will be resolved through binding arbitration.
• The venue for such proceedings will be Sacramento, CA, unless otherwise specified.
• Technicians agree to attempt resolution of customer disputes directly before escalating further.
9. Changes to Terms
• We may update these terms periodically and will provide notice of significant changes.
• Continued use of the App after updates constitutes acceptance.
• Material changes may require explicit acceptance from you before continuing to use the platform.
